Practice Areas
Many people in Wisconsin must navigate the complexities of the legal system at some time in order to resolve matters that are critical to their lives. Two key areas in which the law can alter an individual’s existence are criminal defense and family law. A trial verdict or a court order can affect the future of you and your family for years to come. At Reddin & Singer, LLP, our Milwaukee criminal defense and family law lawyers provide our clients with the diligent representation that they need to assert their rights.
Protecting Your Rights against the ProsecutionIn most circumstances, criminal charges require the prosecution to show beyond a reasonable doubt that the defendant committed each of the required elements of the crime. This generally means that the defendant needs to provide only a plausible alternative version of events to defeat the charges.
Many defenses may be available to challenge the prosecution’s arguments, depending on the situation. In a drug case, for example, evidence may be excluded under the Fourth Amendment if law enforcement seized it without an appropriate warrant, unless an exception to the warrant requirement applies. The prosecution’s case may fall apart if it lacks tangible evidence, such as controlled substances or associated paraphernalia. In a DUI case, a breathalyzer reading sometimes may be challenged on the grounds that the device was not properly calibrated, or a defense lawyer may question the reliability of a field sobriety test. More complex defenses like self-defense may be available to people charged with violent crimes like homicides.
No matter your situation, we can work with you to determine the strategy best suited to your case. At Reddin & Singer, we represent individuals facing charges of both felonies and misdemeanors. If you are charged with a crime under a federal statute, our attorneys are also experienced in defending against those charges in federal court.
Diligent Representation during a DivorceDissolving a marriage often raises many important related issues, such as child custody and placement, child support, and the division of valuable assets. In most instances, a court will favor a plan under which both parents share custody of a child, which is comprised of physical and legal custody. While physical custody consists of the actual time spent with each parent, legal custody consists of each parent’s right to make important decisions regarding the child’s upbringing. The key standard in these proceedings is the best interests of the child, which involves many statutorily enumerated factors. A parent who spends less than 50 percent of the time with the child probably will be ordered to make child support payments to the primary custodial parent, as determined by Wisconsin guidelines.
Dividing property in a high-asset divorce may become a challenging endeavor. Wisconsin is a community property state, which means that a court normally will divide property evenly between two divorcing spouses. In some instances, however, a prenuptial agreement may control which spouse retains control over a certain asset, often protecting property that one spouse brought into the marriage. These agreements are generally enforceable but may be challenged on the basis of duress or misrepresentations.
At Reddin & Singer, our attorneys have assisted many individuals in divorces involving substantial assets and young children. We understand how to craft plans for the future and pursue a modification from a court when circumstances change.
