In most circumstances, criminal charges require the prosecution to show beyond a reasonable doubt that the defendant committed each of the required elements of the crime. This generally means that the defendant needs to provide only a plausible alternative version of events to defeat the charges.

Diligent Representation during a Divorce

Dissolving a marriage often raises many important related issues, such as child custody and placement, child support, and the division of valuable assets. In most instances, a court will favor a plan under which both parents share custody of a child, which is comprised of physical and legal custody. While physical custody consists of the actual time spent with each parent, legal custody consists of each parent’s right to make important decisions regarding the child’s upbringing. The key standard in these proceedings is the best interests of the child, which involves many statutorily enumerated factors. A parent who spends less than 50 percent of the time with the child probably will be ordered to make child support payments to the primary custodial parent, as determined by Wisconsin guidelines.

Dividing property in a high-asset divorce may become a challenging endeavor. Wisconsin is a community property state, which means that a court normally will divide property evenly between two divorcing spouses. In some instances, however, a prenuptial agreement may control which spouse retains control over a certain asset, often protecting property that one spouse brought into the marriage. These agreements are generally enforceable but may be challenged on the basis of duress or misrepresentations.
